Terms and Conditions

Last updated 5 November 2026

1. About these terms

1.1 These terms apply to all goods and services supplied by Simple Group Limited trading as AES Waterblasters (AES, we, us), NZBN 9429052274640, GST 143-525-902, of 46b Sir William Avenue, East Tamaki, Auckland 2013. Postal address PO Box 58 636, Botany, Auckland 2163. Phone +64 9 271 4782, email [email protected].

1.2 You means the person or business buying from us. You accept these terms when you place an order, accept a quote, open a credit account, or accept delivery of goods.

1.3 A consumer has the meaning given in the Consumer Guarantees Act 1993 (CGA). In general, this is anyone who buys goods or services of a kind ordinarily acquired for personal, domestic or household use, and not for resupply in trade or for use up in manufacturing or repairs. A business can be a consumer. A business buyer is anyone who buys in trade.

1.4 Nothing in these terms limits any right a consumer has under the CGA, the Fair Trading Act 1986 (FTA) or any other law that cannot be excluded.

1.5 These terms apply in place of any terms you supply, unless we agree otherwise in writing. Anything specifically agreed in writing on a quote or order takes priority over these terms.

1.6 We may update these terms by publishing a new version on our website. The version published when you place an order applies to that order.

2. Quotes, orders and prices

2.1 Prices are in New Zealand dollars. Website prices include GST. Quotes and invoices show GST as stated on the document.

2.2 A quote is valid for 30 days unless it says otherwise, and is subject to prior sale.

2.3 An order is accepted when we confirm it in writing, send the goods, or start the work.

2.4 If a supplier’s cost, a freight cost or an exchange rate changes after you order and before we supply, we will tell you the new price before we proceed. You may then cancel that order or the affected item without charge.

2.5 Goods made, built or ordered in specially for you cannot be cancelled once we have started or committed to the order, unless we agree or the law requires otherwise.

2.6 Photos, specifications and performance figures are a guide. Manufacturers may change their products. We will tell you before supply if a change materially affects what you ordered.

2.7 We may correct an obvious pricing or description error. If the error affects your order, we will contact you, and you may cancel for a full refund of anything paid.

3. Payment and credit accounts

3.1 Unless you have an approved credit account, payment is due before or on supply, by the method shown on your quote, pro forma invoice or at checkout. Custom builds require a 20% deposit to confirm the order, with the balance payable before delivery or collection.

3.2 We invoice only for goods actually delivered or supplied. If an order is part-filled, the balance is invoiced when it is supplied.

3.3 Credit accounts are for business buyers and are subject to approval. We may ask for trade references or a personal guarantee. Credit account invoices are due by the 20th of the month following the invoice date, unless other terms are stated on the invoice. These terms apply to every credit account, including accounts opened before these terms were published and accounts that came to us when we bought the AES business. They do not replace any guarantee or security you have already given.

3.4 We may change or withdraw a credit limit, or require payment in advance, if your account is overdue or your circumstances materially change. We will tell you when we do this.

3.5 If a credit account invoice is overdue, we may charge interest on the overdue amount at 2% per month from the due date until payment, and suspend further supply until the account is paid up.

3.6 If we have to recover an overdue amount, a business buyer must pay our reasonable costs of recovery, including reasonable debt collection and legal costs.

3.7 If you dispute part of an invoice, tell us promptly and pay the undisputed part by the due date. We will not charge interest on an amount disputed in good faith while the dispute is being resolved.

3.8 You may not set off any amount against an invoice unless we agree in writing or the law allows it.

4. Delivery and risk

4.1 You can collect from East Tamaki by arrangement, or we can arrange delivery. Freight is charged at the rate on your quote, order or checkout, or at cost if none is stated.

4.2 Delivery dates are estimates. We will tell you as soon as we can if an order will be delayed. If a delay is substantial, you may cancel the undelivered part of your order for a refund of anything paid for it.

4.3 We may deliver an order in parts and invoice each part as it is delivered.

4.4 Risk in the goods passes to you:

  • when you or your carrier collect them from us;
  • for business buyers using a carrier we arrange, when the goods are handed to the carrier;
  • for consumers using a carrier we arrange, when you receive the goods.

4.5 Please check goods on arrival and note any visible damage or shortage on the delivery document. Then contact us as soon as you can. This helps us claim from the carrier and does not reduce your rights under clause 6.

4.6 If you do not take delivery when agreed, we may charge reasonable storage and redelivery costs.

5. Ownership and lien

5.1 Goods remain our property until you have paid in full for them and any other amount you owe us for them.

5.2 Until then, you must keep the goods in good condition and identifiable as ours where reasonably practical.

5.3 If an amount is overdue, you become insolvent, or a receiver or liquidator is appointed, we may recover the goods. You allow us to enter the place where the goods are kept, at a reasonable time and with reasonable notice where practical, for that purpose.

5.4 If you owe us an overdue amount, we may keep any of your goods that we hold, such as equipment in for service or repair, until it is paid. For consumers, this covers only amounts owed for those goods or for work on them. For business buyers, it covers any overdue amount you owe us.

5.5 Before selling goods held under clause 5.4, we will give at least 10 working days’ written notice to you and anyone else the law requires us to notify. You may pay what you owe and collect the goods at any time before the sale.

5.6 For consumers, we will not sell unless the amount has been unpaid for at least 2 months, and any sale will be by auction.

5.7 We will take reasonable steps to obtain the best price reasonably obtainable, and apply the proceeds to the amount owed and our reasonable costs of storage and sale. We will give you a statement of account and deal with any balance as the law requires.

6. Returns, warranty and your legal rights

Your rights if you are a consumer

6.1 Our goods come with guarantees that cannot be excluded under the CGA. If goods are faulty, do not match their description, or are not fit for purpose, you may be entitled to a repair, replacement or refund, as the CGA provides. If the failure is serious, you may reject the goods. No time limit or restocking fee in these terms applies to those rights.

6.2 We may use refurbished parts in a repair. If we might, we will tell you before the repair is done.

Change-of-mind returns

6.3 We are not required to accept a return because you changed your mind, but we may do so within 14 days of delivery if the goods are unused, in original packaging and with your invoice or packing slip number. We may charge a 10% handling fee, and you pay return freight.

6.4 We cannot accept change-of-mind returns of goods that have been used, cut to length, built or ordered in specially for you, or sold as clearance.

Warranty

6.5 Units we build carry our warranty against faulty parts or workmanship, for domestic and commercial buyers alike, running from delivery: 12 months on the pump and components, including the electric motor on electric units, and 36 months on Honda or Yanmar engines if the engine is serviced to the manufacturer’s schedule. Second-hand goods we sell carry a 3-month warranty against faulty parts or workmanship, running from delivery, unless the quote or invoice states otherwise. Other new goods carry the manufacturer’s warranty stated for that product, if any. These warranties are in addition to your rights under the law. Please keep your proof of purchase.

6.6 A warranty does not cover normal wear, consumable parts such as seals, nozzles and hoses, or damage from misuse, frost, running dry, wrong fuel or oil, poor water supply, lack of maintenance, or repairs by someone not authorised. Consumer rights under the CGA still apply.

Business buyers

6.7 If you buy goods or services in trade and have agreed to this clause in writing, for example when accepting a quote or by email, the CGA does not apply, and sections 9, 12A, 13 and 14(1) of the FTA do not apply to the extent the law allows. You and we agree that this is fair and reasonable given that we are both in trade. We will still honour clause 6.5, and will repair, replace or refund goods that we accept were faulty when supplied.

6.8 Business buyers must notify us of a visible fault, damage or shortage within 7 days of delivery, and of any other fault within a reasonable time of finding it.

How to make a claim

6.9 Contact us at [email protected] or +64 9 271 4782 with your invoice number and a description of the problem. Please do not send goods back until we have agreed how the return will be handled. For a valid consumer claim, we cover reasonable return costs as the CGA requires.

7. Service and repair work

7.1 We carry out service and repair work at our East Tamaki workshop, and on site within the Auckland region, with reasonable care and skill. Any repair estimate is a guide unless we give it as a fixed quote. We will contact you before going materially over an estimate.

7.2 Parts replaced in a repair become ours unless you ask to keep them when booking the work in.

7.3 We will tell you when your equipment is ready. If it is not collected, we may charge reasonable storage. If it is still uncollected after we have given written notice and a reasonable time to collect, we may dispose of it following the process the law requires, apply any proceeds to amounts owed, and deal with any balance as the law requires.

8. Safe use

8.1 High-pressure equipment can cause serious injury. You must read and follow the manufacturer’s instructions, use suitable protective equipment, make sure operators are trained, and never point a lance or jet at a person or animal.

8.2 If you buy for a business, you are responsible for meeting your duties under the Health and Safety at Work Act 2015 for the equipment’s use, maintenance and any required training.

9. Liability

9.1 Nothing in these terms excludes liability that cannot be excluded by law, including under the CGA or the FTA for consumers.

9.2 We are not liable for delay or failure caused by events beyond our reasonable control, such as supplier or shipping disruption, natural events or industrial action. We will tell you as soon as we reasonably can.

9.3 For business buyers, to the extent the law allows:

  • we are not liable for loss of profit, loss of use, downtime, or indirect or consequential loss;
  • our total liability for any claim is limited to a maximum of NZ$50,000.

9.4 For loss caused by our negligence, the NZ$50,000 limit in clause 9.3 applies, but the exclusion of loss of profit, loss of use, downtime, and indirect or consequential loss does not. Clause 9.3 does not apply to loss caused by our fraud or wilful misconduct.

10. Intellectual property

Our website content, brochures, drawings and technical documents remain ours or our suppliers’. You may use them to choose, operate and maintain the goods you buy, but may not copy them for any other purpose without our written consent.

11. Privacy

We collect and use your personal information to process orders, manage accounts, provide support and, for credit accounts, to assess credit. We handle it under the Privacy Act 2020. You may ask to see or correct your information by contacting [email protected].

12. General

12.1 These terms and your contract with us are governed by New Zealand law, and the New Zealand courts have non-exclusive jurisdiction.

12.2 The United Nations Convention on Contracts for the International Sale of Goods does not apply.

12.3 If part of these terms cannot be enforced, the rest stays in effect.

12.4 If we do not enforce a right straight away, we have not given it up.

12.5 You may not transfer your rights or obligations under a contract with us without our written consent. We may transfer ours to a business that takes over the relevant part of our operations, if this does not reduce your rights.

12.6 Notices may be given by email or post to the last address either of us gave the other.
